Can a court order a defendant to sell there personal property to pay for a debt owed on a credit car

I%26#039;ve been receiving letters from a collection agency %26amp; recently received one stating my properties have been levied upon and they list all my personal belongings, tv, clothes, washer, dryer, fridge, silver, jewelry, linens etc. Can they do this? And my SSI check. The letter head says Superior Court of NJ. Is this possible because I stopped paying my creditor?

Thank You for any help!

Jackie

Can a court order a defendant to sell there personal property to pay for a debt owed on a credit card?

they can send a sheriff to your door to make a list of what you own (your personal property), but thats only after a court order has been issued.... which it sounds like has been done.

they CAN NOT touch your SSI, as far as I know.

contact your local Legal Aid Office, here are the links. they will file bankruptcy for you for little to no money/cost.

CREDIT AND CREDITOR LAWS

--10 MILLION people per year are victims of Identity Theft.

--Todays growing target for criminals; are children and teens identities (SS#). Why? Because parents never think to check/protect their childrens reports.

1) run a free credit report from each agency (your allowed one free one per year, per agency). you need to know, so you need to get them.

2) Check your childrens also (check the link below as to how to)

3) if ID Theft has occurred, you need to make a police report first. the rest of what you need to do, is listed in the links below (with GREAT info too).

4) some states allow you to %26#039;lock%26#039; or %26#039;freeze%26#039; credit reports; to protect against theft. if your state allows it, lock %26#039;em down. that way, no one can open an account on them.

5) once you discover their credit reports have activity on them, then contact each credit reporting agency (the 3 major ones) and report the ID Theft... and request they lock the reports (usually they automatically do it, but ask for it anyway).

REMEMBER; you are only allowed to run credit reports on YOURSELF and YOUR MINOR CHILDREN (NO, not when they are adults).

To run a report on anyone else, they have to authorize it, and you better have proof of that authorization. If you do it without their knowledge, you are legally liable and they can not only report you to the state/federal authorities, but they may decide to sue you in a court of law.

CAPITAL ONE

Capital One refuses to report its customers%26#039; credit limits to the three major credit bureaus. Instead, the bureaus use the highest balance a customer has charged as a proxy for the limit.

As a result, the customers%26#039; all-important %26quot;debt utilization ratios%26quot; -- the portion of their available credit these borrowers are actually using -- can appear artificially high. That can depress borrowers%26#039; credit scores, the three-digit numbers lenders use to help determine creditworthiness.

Lower credit scores can mean higher interest rates on mortgages, car loans and other borrowing, as well as potentially higher insurance premiums, since many insurers also use credit-scoring systems to help gauge risk.

Can a court order a defendant to sell there personal property to pay for a debt owed on a credit card?

That depends a great deal in what state you live in. I do not believe that any creditor can take Social Security payments for an outstanding debt. Can%26#039;t you contact the creditor and arrange some sort of payment to them? a charge off is one of the worst things to happen to your credit rating! Every state has a free legal service office and I would contact them through your local Bar Association for advice. your dealing with state law here and a free lawyer in New Jersey would best answer this for you!

Can a court order a defendant to sell there personal property to pay for a debt owed on a credit card?

Certainly not in the UK!!

Did they know the make of your personl effects?

Suspect it is another method of scary tactics.

Can a court order a defendant to sell there personal property to pay for a debt owed on a credit card?

Yes it is possible. They have a judgment against you and have gone to court and filed liens on your personal property.

This is all legal and within their rights to collect on your debt.
