I have about $2800 in debt on one credit card that has been passed along to a lawyer for collection?

I am unable to pay it, and they are unwilling to take monthly payments. They have been calling me once a day for about the past year. My question is, will this just continue indefinitely until I can pay them, or will they try to repo my car and stuff, or what?

Well first we need some more information.



1. What state do you live in?



2. When did you most recently become delinquent on the account with the original creditor?



This is important, as every state has different laws regarding the statue of limitations. Depending on how old the debt is, they may not be able to sue you over it anymore.



First, I would send them a certified letter stating to cease and desist all phone calls and to only contact you through the mail. Next, I would send another certified letter demanding that they validate the debt and show it is not past the statue of limitations.

You%26#039;ll notice that right above that is a link giving info about how you can settle your debts for less. If they can jump through all the hoops outlined in the debt validation section, that would be your next step.



Remember to always send your settlement/payment plan offers through certified mail and obviously keep copies of the letters and delivery receipts. Should this actually go to court, it will definetly help your cause if you can show that you tried to work out a payment plan.



I would not worry much. Chances of an actual lawsuit are small, and at worse they could garnish your wages or place a lein on your property, but the judge can order payment plans that you can afford, so again I don%26#039;t feel it%26#039;s much to worry about.

You never said how old the debt was - so first I%26#039;d check to see if the statute of limitations has run out... Report It

after that comes wage garnishment and/or other steps.

when it goes through collections, you have the chance of settling. come up with a figure that you know you can pay off.



they would rather see half than nothing at all.

If it%26#039;s only $2800, what if you sold the car, paid the debt, and then bought a used car?

I would definitely contact them and see what is going on. You may be able to work out something.



They may feel that $1400 is better than nothing or them having to pay to go to court.



As high as some of their interest rates are, the actual cost to them may not be that much.
