Back in July of 2006 i was sued by lawyers working for a credit card agency....?

for an old credit card debt..i went to small claims where they obtained a judgment against me...which i have been paying until december as i went into the hospital...so i could not send them the full amount but i paid them as much as i could..they sent me a letter saying they could garnish my wage $200 a month if i didn%26#039;t send them a certain amount by Jan 20. My husband does not work, i support him 100%. (He can%26#039;t work yet because of Immigration laws at this time, waiting on INS paperwork)



I%26#039;m just wondering is there anything we can do to stop this?



as on top of this bill we also now have $10,000 plus of hospital/doctor bills....



in the letter, they said something about a garnishment hearing..does that mean i have a right to show up and defend myself and explain to the judge the situation?

so stop paying and le it go as a bad debt.

Yes you have the right to defend yourself at the garnishment hearing. Try explaining that you were in the hospital.

I%26#039;m sorry to hear about your problems. You should always have a right to present your view in front of a judge. I would also recommend that you check in your town for a free credit help service. Many times they can get your creditors to back off on the pressure and possibly work out a reduced payment schedule.

do not follow corks advise, they have that judgment against you and the next step is to get a wite of garnishment against you. They took the efforts to get the judgment against you now its to a garnishment hearing. Have you contacted the cc company or lawyers??? you need to do that, tell them if you start garnishing my wages i will have no choice then to go bankrupt. That will raise some eyebrows!!! Then the ball will start to go in your court, they will rebuttal stating the laws have changed blah blah blah, tell them you know that and my lawyer dose too. push that piece of defense, then hopefully they will agree to YOUR terms, make sure that is in writing. If not go to the court date and plead your case.
